Deviations from these conditions must be addressed in a written agreement between all parties involved.
In order to be declared admissible, any complaints about services or goods provided must be detailed and provided in written form within seven days after delivery of the service and / or good. Complaints concerning invoices must be sent (with sufficient details) by registered letter and within seven days of receipt of the invoice.
Unless otherwise agreed or otherwise indicated on the invoice, all invoices are payable at the registered office of our company within 30 days after the invoice date.
In the event of late payment of an invoice, it will be automatically and without any prior notice raised with a default interest of 12% per annum, starting from the due date until full payment of the invoice. In that case the customer is also to pay a lump sum indemnity amounting to 10% of the invoice amount, with a minimum of 50.00 euros. All recovery costs and lawyer fees are fully borne by the customer.
In the event of termination or cancellation of an order by the client, the latter is to pay a fixed compensation of 30% of the value of the ordered services or works, without prejudice to our right to demand the full implementation of the agreement.
In case of non-timely payment of an invoice, all other not yet due claims against the client shall automatically be immediately due and payable without notice.
The delivered merchandise remains our property until the full price (principal, interest and costs) is paid. The purchaser bears the risks from delivery onwards.
The warranty on the delivered goods or services is limited to the warranty granted by our suppliers. Our services and benefits are in any case to be considered as an obligation of means. We cannot be held liable in any way for any damages (direct or indirect damages, lost profits, consequential damages, etc.) which would arise from or in connection with our services.
All our contracts are governed by Belgian law. Unless otherwise mandatory legislation, all disputes are to be settled by the peace courts and the courts of the judicial district of the seat of our company.
